Abstract
<jats:p>The article analyzes the opportunities and legal regulatory mechanisms created by rapidly evolving digital technologies in the modern era for human rights, particularly the right to privacy and the protection of personal data. Issues such as the processing, storage, dissemination of personal data, and the right to control such data are examined within the framework of both national and international legal systems. Legal and comprehensive measures implemented in this area in the Republic of Azerbaijan occupy a central place in the analysis. Beginning with the right to privacy enshrined in Article 32 of the Constitution of the Republic of Azerbaijan, other relevant legislative acts are examined in detail. The formation of the legal framework is not limited solely to fulfilling certain international obligations but also serves as an integral part of national state policy. In addition, liability measures applied against unauthorized collection and dissemination of personal data demonstrate the further strengthening of legal safeguards in this field. The article also includes a dedicated section on the legal and ethical aspects of applying artificial intelligence (AI) technologies. In this section, the provisions of the European Union’s Artificial Intelligence Act adopted in 2024 covering data processing, risk management, transparency, and oversight mechanisms, are analyzed, and a comparative assessment is made of how these regulations align with the national approach of the Republic of Azerbaijan. Based on the three-year Artificial Intelligence Strategy for 2025–2028, the ethical and responsible application of AI, the formation of a legal and regulatory framework, and the protection of privacy are identified as key directions for future development.
