Abstract

<jats:p>Meeting the demand for healthcare services aimed at treating and monitoring an increasing number of patients with chronic diseases, eliminating health risks for those living in rural and hard-to-reach areas, and monitoring elderly and disabled patients with limited mobility exceeds the capacity of traditional face-to-face services. Moreover, in situations such as a pandemic, where physical contact and even leaving the house are restricted, it is not possible to see a physician in person. Today, computer network systems, information and communication technology, and digitalisation are being developed to address these issues and enable the provision of remote healthcare services (telemedicine). Thanks to digitalisation in medicine, many diseases can now be diagnosed and treated remotely, eliminating time and space constraints and reducing the need for offıce or hospital visits and waiting times. Platforms created on websites currently offer remote healthcare services to patients in almost all areas of medicine. Through these platforms, patients can access world-renowned doctors at lower cost via audio and video conference calls, transcending national borders, and receive treatment for their illnesses. Although remote healthcare services offer these benefits, they also impose additional obligations on physicians and patients, and make it difficult to clearly determine the legal liability of the parties. For example, in audio and video conferences between physicians and patients, it is unclear who is responsible for protecting the patient s personal data, ensuring clear transmission of sound and images, and obtaining full clinical information about the patient. This raises the question of the physicians liability for compensating patients for any material and moral damage resulting from a breach of these obligations. Our thesis examines these questions and focuses on how legal regulations should be established in this regard.</jats:p>
