Abstract

<jats:p>In order to ensure the prosperity of humanity, it is crucial to take necessary measures to prevent the intensification of environmental problems, especially climate change. In this regard, most countries ensure the effectiveness of environmental and legal regulation by adopting environmental legislative acts and further improving the existing legal framework. There are a number of legislative acts addressing various aspects of environmental protection in our country. This study analyses the Law of the Republic of Azerbaijan “on Environmental Protection” which is one of the main legislative acts in the field of environmental protection. In particular, the analysis was conducted in terms of socio-economic development in 26 years after adoption of the Law and the amendments made to the Law during these years were examined. In addition, the research was conducted on the basis of specific structural elements of the Law, a number of collisions and legal gaps were identified and an assessment was carried out in terms of advanced law-making techniques. The study revealed that the Law lacks modern concepts of environmental and climate regulation, as well as only two of the amendments adopted since its enactment can be considered improvements to its regulatory scope. Furthermore, the Law includes numerous norms that do not provide clear regulation, as well as inconsistencies and legal gaps. It also does not conform to contemporary law-making techniques, and therefore, fundamental legislative amendments have been proposed to ensure effective environmental and legal regulation.
