Abstract

<jats:p>The article examines the issues surrounding the detention of a person during a preliminary investigation based on reasonable suspicion of having committed a crime. It then addresses the situation where, immediately after their release or after a few minutes, the accused - who is already free - is presented to the court. These studies were conducted within the framework of the Criminal Procedure Code of the Republic of Armenia. In this work, an attempt was made to identify the most frequently encountered problems in the practice of the above-mentioned institution, to identify legislative gaps, incomplete regulations and to propose solutions for emerging situations. In the framework of this study, we will explore whether a person can be arrested on the grounds of reasonable suspicion and then presented to court shortly after being released.</jats:p>
