Abstract
<jats:p>The article is dedicated to the study of the regulations for releasing persons from liability due to “active remorse”. Bearing in mind that Article 81 of the RA Criminal Code was supplemented with part 1.1 under the Law HO-273-N of 12.07.23, according to which persons having committed grave and particularly grave criminal offences may be released from responsibility due to active remorse, this institution has become the subject of study in legal, spiritual and psychological aspects of remorse. The article reveals the essence of the falsification principle as a methodology verifying the genuineness of remorse. The paradigms of remorse and cooperation have been singled out as models confirming the effectiveness of remorse in criminal offences of minor or medium gravity, as well grave and particularly grave criminal offences. Particular emphasis was placed on the spiritual and psychological aspects of remorse. Through the study of scientific research, an attempt was made to show that part 1.2 of Article 81 of the RA Criminal Code needs to be supplemented with a number of crimes, such as crimes against sexual freedom and sexual immunity, and child trafficking.</jats:p>
