Grundrechtliche Schutzpflichten bei Sachverhalten mit Auslandsbezug

<p>The work explores the applicability and design of duties to protect in cases with an international dimension. Whilst the application of the defensive aspect of the German fundamental rights is largely recognised in case law, the discourse regarding constitutional duties to protect is still in its infancy. The thesis therefore first examines the applicability of the German fundamental rights abroad, taking into account potential conflicts under international law, before going on to analyse the substantive content of the duty to protect abroad. In doing so, the thesis demonstrates how the constitutional duties of protection can be applied to cases with an international dimension in accordance with established legal doctrine.</p>
