Abstract

Although performance monitoring in the home office is obviously difficult, there are no specific legal provisions governing this. The only legal requirement is that monitoring measures must be "proportionate". The vagueness of this requirement is accompanied by enormous legal uncertainty for all parties involved. In her dissertation, the author develops a system that enables reliable control assessment in this highly sensitive area of data protection law. It brings together the standards for specifying the proportionality requirement that are distributed across the European multi-level system, abstracts and structures them, and aligns them with the specific control situation in the home office.
