Abstract

This work presents the previously missing contribution of criminal law to the discussion on the possibilities of combating inaccurate medical information. It determines possible types of medical information, defines their respective inaccuracy, and examines the detrimental effect of such information on various legal interests. Based on the type of offense recognized as appropriate, namely abstract endangerment offense, the work then goes on to further specify the elements of abstractly dangerous behavior. These considerations culminate in a concrete proposal for a criminal offense with which medical disinformation can and must be addressed.
