Abstract

<p>Further investigations in antitrust proceedings transferred by the courts are a very important tool. However, their legal analysis has so far been largely neglected in German competition law infringement. Using the example of the Higher Regional Court of Düsseldorf and the Federal Cartel Office, the author explains in detail whether such an approach is permitted by law, what legal options are available for the court, what requirements and limitations it must observe, and how it can effectively enforce the execution of further investigations if necessary. The work combines antitrust issues with provisions of German criminal procedure, principles of the Federal Constitution and the European Convention on Human Rights.</p>
