Abstract

Human beings act for reasons in sexual interactions. However, not every action is voluntary, e.g. when a person engages in sex under the influence of a threat. In this case, he or she is coerced. But how should we assess situations in which the perpetrator acts more subtly, e.g. by requesting sex in a hierarchical context or by making an offer that exploits another person's hardship and demanding sex in return? This dissertation explores the meaning of involuntary actions in law and examines when, under the 'no means no' solution, sexual boundary violations can be assumed to have occurred if the victim participates actively in sexual interactions.
