Abstract

The doctoral thesis examines the relationship between legal and cultural pluralism and the universality of human rights using the example of artistic freedom of expression in the case law of the ECHR. It combines classical legal methods with interdisciplinary approaches from sociology, ethnology and hermeneutics. The ‘law in context’ approach links legal, cultural and social perspectives. Through the analysis of the concept of culture, the concepts of legal and cultural pluralism, and case law, universalising criteria are identified that can be understood as both limitations and opportunities for the universality of human rights.
