Abstract

Space mining offers vast potential – but also significant risks. This academic work examines whether self-regulation or soft law can provide adequate governance. While self-regulation offers flexibility, it lacks sanctions and environmental safeguards. In comparison, only an international treaty can uphold the principles of space law, prevent conflicts, and ensure sustainable use. The study develops concrete proposals for such a framework – from an international authority and liability regime to environmental standards. It addresses lawyers, policymakers, industry, and all those interested in the future of outer space.
