Abstract
<p>Under § 327h of the German Civil Code (BGB), it is only possible to deviate from consumers’ objective expectations regarding the quality of a digital product if consumers have been specifically informed of the deviation and have accepted it expressly and separately. This dissertation examines whether this mechanism fulfils the criteria of an information model or, by emphasising specific particularly important information, even represents a further development of the information model. Based on previous studies on the effectiveness of information, it discusses whether the provision can contribute to an informed consumer decision and how its effect might be enhanced through further measures.</p>
