Abstract

<p>The thesis analyzes the requirements under which intelligent systems may be used in the area of the application of law by judges. Before the constitutional analysis, the phases of system development are first discussed, including the task description and data selection. The constitutional assessment depends on whether the systems would be used in support of or instead of judges. For this purpose, the extent to which judicial decision-making powers may be delegated to intelligent systems is examined. As supporting decision-making tools, it must be ensured that judicial independence and the constitutional legitimacy of the judicial decision are safeguarded by possible control mechanisms. Finally, criteria for assessing the potential applications are formulated and regulatory challenges are identified.</p>
