Abstract

<p>The criminal case against Giessen doctor Kristina Hänel has made legal history: In 2017, the Giessen public prosecutor's office charged Hänel with a violation of Section 219a of the German Criminal Code (StGB). The process through the criminal courts took several years and ended with a conviction. On June 24, 2022, the German Bundestag abolished the provision of § 219a StGB without replacement and overturned all relevant criminal convictions. This anthology documents the historical process and the strategy of "successful defeat" used by ifw. From the ifw's point of view, it was obvious that the discussion could not stop at § 219a StGB. The debate on § 218 StGB was an inevitable consequence. With contributions by Prof. Dr. Frauke Brosius-Gersdorf, LL.M. | Kristina Hänel | Jessica Hamed | Dr. Karlheinz Merkel † | Prof. Dr. Reinhard Merkel | Dr. Jacqueline Neumann | Prof. Dr. Ali B.
