Abstract
<jats:p>В статье обоснована теоретическая и практическая значимость исследования духовных основ государства, осуществлена реконструкция понимания проблемы И. А. Ильиным, показана актуальность его идей в осмыслении ключевых проблем существования современного государства и права. На основе анализа политико-правовых взглядов Ильина выявлена специфика трактовки им духовных основ государства как единства религиозных, нравственных и правовых идей, чувств и убеждений, возникающего в результате культурного и исторического опыта народа и обусловленного онтологической духовной природой государства как этапа реализации абсолютного духа в истории. Показана оригинальность понимания Ильиным духовного характера правосознания, взаимосвязи в нем правовых знаний, чувств, доверия, ответственности, действенной воли, дисциплины, характера, религиозной веры, в которых задействована вся человеческая душа. Обоснована актуальность осуществленного Ильиным анализа патриотизма как духовной основы государства и ценностного компонента правосознания. Выявлена прогностическая роль идей И. А. Ильина и их методологическая значимость в исследовании современных теоретико-правовых проблем.</jats:p> <jats:p>The article substantiates theoretical and practical significance of the study of spiritual foundations of the state, reconstructs I.A. Il'in's comprehension of the problem, and shows the relevance of his ideas in the consideration of key problems of the modern state and law. Based on the analysis of Il'in's political and legal views, the specifics of his interpretation of spiritual foundations of the state as a unity of religious, moral and legal ideas, feelings and beliefs arising from the cultural and historical experience of the people and conditioned by the ontological spiritual nature of the state as a stage of realization of the absolute spirit in history is revealed. The author shows the originality of Il'in's understanding of the spiritual nature of legal consciousness, the interrelationship of legal knowledge, feelings, trust, responsibility, effective will, discipline, character, and religious faith in which the entire human soul is involved. The relevance of Il'in's analysis of patriotism as the spiritual foundation of the state and the value component of legal awareness is substantiated. The article reveals the prognostic role of I.A. Il'in's ideas and their methodological significance in the study of modern theoretical and legal problems.</jats:p>
