Abstract
<jats:p xml:lang="en">The opportunity to make easily accessible materials of great historical and legal value led to the publication in open access of the argument given in the late 1800s by Pasquale Stanislao Mancini in defense of the rights of public use (diritti di uso pubblico) claimed by the collectivity over the Villa Borghese in Rome, together with the main judicial decisions concerning the case. In addition to fostering the dissemination of knowledge and the sharing of the information contained in this material, this publication is the occasion for developing a critical dialogue and presenting different points of view on the commons, which precisely in the Villa Borghese case found an important moment, precursor to contemporary debates and case law.</jats:p>
