Abstract
<jats:p>В контексте известной проблемы злоупотребления правом собственниками микродолей в праве на жилые помещения автор данной публикации предлагает включить в научный оборот и действующее законодательство Российской Федерации понятие «жилищно-долевое ограниченное вещное право» в качестве новой разновидности ограниченных вещных правах на жилые помещения. В связи с этим предлагаются изменения в Гражданский кодекс РФ и Жилищный кодекс РФ.</jats:p> <jats:p>In the context of the well-known problem of abuse of rights by owners of micro-shares in residential premises, the author of this publication proposes introducing the concept of "limited property right in shared housing" into academic discourse and current Russian legislation as a new type of limited property right in residential premises. In this regard, amendments to the Civil Code of the Russian Federation and the Housing Code of the Russian Federation are proposed.</jats:p>
