Abstract
<jats:p>Статья посвящена определению современных проблем в сфере уголовно-правового противодействия преступлениям против общественной безопасности, основ конституционного строя и безопасности государства, а также пониманию подходов к устранению ключевых пробелов в квалификации деяний, представляющих угрозу безопасности Российской Федерации в условиях враждебного иностранного вмешательства. На основе детального анализа делается вывод о том, что существующая конструкция уголовного законодательства недостаточно устойчива в условиях гибридного противоборства. Для устранения правовых разрывов требуется глубокое обновление материальных и концептуальных подходов к оценке деяний, наносящих ущерб суверенитету и безопасности Российской Федерации. Внедрение предлагаемого комплекса мер создаст основу для формирования правовой модели, способной учитывать изменения структуры угроз и обеспечивать защиту интересов государства и общества в транснациональной и цифровой среде.</jats:p> <jats:p>The article is devoted to identifying current problems in the field of criminal law counteraction to crimes against public safety, the foundations of the constitutional order, and state security, as well as understanding approaches to eliminating key gaps in the qualification of acts that pose a threat to the security of the Russian Federation in the context of hostile foreign interference. Based on a detailed analysis, it is concluded that the current structure of criminal legislation is not sufficiently stable in the context of hybrid warfare. To address the legal gaps, it is necessary to deeply update the material and conceptual approaches to assessing acts that harm the sovereignty and security of the Russian Federation. The implementation of the proposed set of measures will create a basis for forming a legal model that can take into account changes in the structure of threats and ensure the protection of the interests of the state and society in a transnational and digital environment.</jats:p>
