Abstract
<jats:p>Цель исследования — на основе анализа федеральных и региональных нормативных правовых актов, а также муниципальных актов, регулирующих порядок прохождения государственной гражданской службы субъекта Российской Федерации и муниципальной службы выявить недостатки правового регулирования и сформулировать предложения по совершенствованию института ротации на названных видах публичной службы. Анализируя состояние правового регулирования государственной гражданской службы субъекта Российской Федерации, автор показывает, что это регулирование отличается разной степенью проработанности. Рассматривается также регламентация института ротации на муниципальной службе. Автор указывает, что ни федеральное, ни региональное законодательство не содержит норм о ротации муниципальных служащих. Однако на практике она осуществляется в соответствии с муниципальными актами в крупных муниципальных образованиях, таких как городское поселение и муниципальный район. Формулируются предложения по совершенствованию законодательства по рассматриваемому вопросу.</jats:p> <jats:p>The purpose of the study is to identify shortcomings in legal regulation and formulate proposals for improving the institution of rotation in the named types of public service based on the analysis of federal and regional regulatory legal acts, as well as municipal acts governing the procedure for passing the state civil service of the constituent entity of the Russian Federation and municipal service. Analyzing the state of legal regulation of the state civil service of the constituent entity of the Russian Federation, the author shows that this regulation is characterized by varying degrees of elaboration. The regulation of the institution of rotation in the municipal service is also considered. The author points out that neither federal nor regional legislation contains provisions on the rotation of municipal employees. However, in practice, it is carried out in accordance with municipal acts in large municipalities, such as urban settlements and municipal districts. Proposals are formulated to improve the legislation on the issue under consideration.</jats:p>
