<jats:p>The article uses the example of a specific case to analyze the dispute between various judicial authorities
on presence or absence of constituent elements of the crime set forth by Part 1, Art. 286 of the Criminal Code
of the Russian Federation in actions of official of the Federal Penitentiary Service Vankaev who has duly fulfilled
an actually legitimate order of his superior.</jats:p>
