Abstract

Currently the construction industry in Russia is undergoing a significant transformation, including in the field of man-agement. Legal consulting is also changing, mainly due to the influence of digitalization of interaction with the state and the introduction of AI into work. Without well-established legal support, the process of transformation of the con-struction industry can entail risks for both customers and contractors, especially for small companies. The purpose of the work is to investigate the transformation of the provision of legal services in the construction sector and to develop recommendations for improving the effectiveness of contract management in the construction business. Research methods: assessment of management capital (in the context of legal services), system analysis, modeling, analysis of laws and tender documentation. The authors define legal consulting, consider the place of legal consulting in the man-agement capital system of a client company, and develop an algorithm for interaction within a construction company that integrates legal competencies into all stages of the investment and construction cycle, taking into account the con-tribution of legal services. The development of legal consulting in the construction sector towards full-fledged contract and risk management, organizational and managerial engineering, manifested in the participation of a lawyer in con-tract management from the moment of preparation and conclusion, ending with the support of all actions for the suc-cessful completion of the project ensuring maximum client interest and minimal costs, has been revealed. Unlike tradi-tional approaches, the scientific result is based on a synthesis of the theory of stakeholders and the concept of minimiz-ing transaction costs, which allows us to consider a legal service as an asset that increases the market value of a busi-ness.
