<jats:p>The Federal Constitutional Court has established a core area of private life which the state must not infringe on no matter what objective it may be pursuing. According to the court, legislators are obliged to enact provisions to actively safeguard this area. However, contradictions within the concept itself make this no easy task for legislators.</jats:p>
