Abstract

<jats:p>In Germany, the efforts to constitutionalize criminal law are still in its infancy. Neither a specific nor a substantial concept of personal autonomy have yet been developed to provide substantive standards in evaluating the use of punitive power. The constitutional limits of using criminal law as a preventive measure are therefore unclear. Martin Nettesheims study reveals standards that could be set.</jats:p>
