Abstract

<jats:p>In view of the constitutional crisis progressing since 2015, addressing the issue of the systemic location of the Supreme Court and the Constitutional Court seems particularly important now. The analyses carried out in this dissertation are aimed at indicating the fundamental assumptions that determine the way both authorities operate. A reconstruction of these assumptions should be reflected in particular in an analysis of the historical process that has led to the adoption by the legislator of certain normative solutions. Against this background, it is possible to answer the question to what extent the model of the judicial authority system, together with the role of the Supreme Court (SC) and the Constitutional Tribunal (CT) defined within it, has been determined by the Polish legal culture and being a resultant of certain historical experiences, and to what extent our legal culture has not defined this model.</jats:p>
