Abstract

Abstract
Smith on the Law of Assignment is a well-established work, first published in 2008, dealing with all aspects of intangible property. Intangible property—or choses in action—are the most economically significant form of property in the world today, comprising not merely contractual rights and debts, but also shares and other securities and intellectual property rights, as well as the causes of action by which disputes are litigated and resolved. This form of property is, by its nature, cross-border. The work describes the nature of the various forms of right that comprise intangible property and deals with the complex rules that govern jurisdiction (whether an English court has jurisdiction or not) and applicable law (what law applies to any given issue, assuming an English court has jurisdiction).
